On your ticket you will find an extract of the “General Conditions of Carriage”, the full text of which is available at our offices and on this website, and which are subject to the applicable Law.
Important Notice
We recommend our passengers not to leave any valuable articles or documents in checked baggage.
The carrier refuses any liability in case of pilferage.
Passenger must check the ticket, especially acceptance deadline and the conditions.
Check-in acceptance deadline
The term "check-in acceptance deadline" refers to the latest time at which passengers can be accepted for travel with respect to the departure time show on their flight coupon and the time by which passengers should have been checked-in and in possession of their boarding cards. Once the specified deadline has elapsed, check-in counter will close and the Company reserves the right to assign any circumstantial unoccupied seat to passenger registered on a waiting list.
Due to increased airport security measures and in the interest of punctual flight departures, from the 1st March 2006 the limit for checking in will be 45 minutes before the scheduled departure time of the flight.
Denied boarding, cancellation or long delay
According to the established procedures for the sale and reservation of seats, it is possible the the situation may occur whereby due to lack of available seating on a flight, passenger may not be admitted onto the flight despite being in possession of a ticket confirming a reserved seat.
The European Council Regulation Nº 261/2004 dated February 11th 2004, establishes common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights, and repaling Regulation (ECC) Nº295/91.
On request, the Air Carrier will provide a printed copy of the rights of the passenger, specifically those relating to compensation and assistance, to those passengers who have been denied boarding, or suffered a cancellation or delay of more than two hours.
Should the passenger require any additional clarification or have any queries regarding the application of this procedure, for flights departing from or arriving at a Spanish airport, enquiries may be made to: "Ministerio de Fomento, Dirección General de Aviación Civil, Subdirrección General de Explotación del Transporte Aéreo, sección de Atención al Usuario, Psaeo de la Castellana, 67, 28071 - Madrid (Spain)".
Baggage allowance
The free baggage allowance is specified on the plane ticket flight coupon and will differ according to the conditions associated with the tariff that has been paid. In general, Business Class permits 30 kg and Economy Class 20 kg. When the total checked-in hold baggage weighs more than the allowance, an excess baggage charge will be applied. The passenger is not allowed to carry more than 60 kg of excess baggage. With regards to all checked-in baggage, the maximum weight for any single piece is 32 kg.
Advice to passengers on limitation of liability
According to Montreal Convention and the Community by Regulation (EC) No 2027/97, there are no financial limits to the liability for passengers in the case of injury or death. For damages up to 100000 SDRs* (approximately EUR 107.000) the air carrier cannot contest claims for compensation.
Above that amount, the air carrier can defend itself against a claim by proving that it was not negligent or otherwise at fault.
However, if the air carrier proves that the negligence of the injured or deceased passenger caused or contributed to the damage, AIR EUROPA LÍNEAS AÉREAS may be exonerated wholly or partly from its liability in accordance with applicable law.
For death or personal injury of passengers, the air carrier must make an advance payment, to cover immediate economic needs, within 15 days from the identification of the person entitled to compensation. In the event of death, this advance payment shall not be less than 16000 SDRs* (approximately EUR 17.000).
Notice of baggage liability limitations
According to Montreal Convention and the Regulation (EC) No 2027/97, AIR EUROPA LÍNEAS AÉREAS is liable for destruction, loss or damage to baggage up to 1.000 SDRs* (approximately EUR 1.100). With respect to checked-in baggage, the Company is liable even if not at fault, unless the baggage was defective or the damage is resulted from inherent defect, quality or vice of the baggage. With respect to unchecked-in baggage, the carrier is liable only if at fault.
In case of delayed baggage, the air carrier is liable for damage unless it took all reasonable measures to avoid the damage or unless it was impossible to take such measures. The liability for baggage delay is limited to 1.000 SDRs* (approximately EUR 1.100).
A passenger can benefit from a higher liability limit by making a special declaration at time of check-in at the very latest and by paying a supplementary fee. The aforementioned declaration is not available for certain types of valuable articles.
Air carrier assumes no liability for fragile, valuable or perishable articles.
If the baggage is damaged, delayed, lost or destroyed, the passenger must write and complain to the air carrier as soon as possible. In the case of damage to already checked-in baggage, the passenger must write and complain within seven days, and in the case of delayed baggage, within 21 days, in both cases from the date on which the baggage was placed at the passenger's disposal.
*Special Drawing (Giro) Rights as defined by the International Monetary Fund.
Conditions of Contract
1. The use of this ticket and baggage receipt will be solely valid for carriage on AIR EUROPA’s flights from the airport of origin to the destination airport via the routes and dates shown on the ticket.
2. As used in this contract “ticket” refers to the passenger ticket and baggage receipt,of which the conditions and the notice form a part. “Carriage” is equivalent to “transportation”. “Carrier” means all air carriers that carry or undertake to carry the passenger and/or his baggage.
Convention for the unification of certain rules for international carriage by air , signed in Montreal on the 28th of May 1999. “Regulations (EC) 2027” is the Regulation 2027/97 adopted by the Council of 9th October concerning airlines liability with respect to air transportation of passengers and their baggage-modified by Regulation (EC) 889/2002. “Ley de Navegación Aérea” means Spanish Air Navigation Law 48/1960, established on the 21st July concerning air carriage and incluiding its subsequent modifications.
3. Transportation realised in virtue of this contract is subject to the norms and limits relative to its liability as stipulated by the Montreal Convention, Regulation (EC) 2027/97, the Spanish Air Navigation Law, modified by the RD 37/2001 and any other compulsory modification applicable.
Such norms and limitations are summarised in the information notes contained in this contract .
4. So as not to contradict the previous paragraph, all foregoing carriages and other services performed by each carrier are subject to: (i) provisions contained in the ticket; (ii) applicable tariffs; (iii) the carrier’s conditions of carriage and related regulations which which form part of this contract (and are available at the office of the Carrier). In the casse of transportation between a place in the United States or Canada and any point of these countries the norms used will be those in force in the relevant country.
5. The Carrier’s name may be abbreviated on the ticket, but the full name and its abbreviation (as indicated on the ticket flight coupon) must be stated in the Carrier’s manual, conditions of carriage, regulations or timetables. The agreed stopovers are those places specified on the ticket or as shown in the carrier’s timetables as scheduled stopovers on the passenger’s route. Carriage undertaken in this manner by several successive carriers is regarded as a single operation.
6. An air carrier issuing a ticket for carriage through the lines of another air carrier does so acting as its Agent.
7. Any exemption or limitation of the air Carrier liability contained in the ticket shall apply to its agents, servants employees and representatives, as well as to any person whose aircraft is used by the carrier for carriage as well as its agents, servants and representatives.
8. Checked-in baggage will be delivered to the bearer of the baggage receipt In case of damage to baggage occurring during transportation a complaint must be made in writing to the carrier immediately after the discovery of the damage and, within at least seven days of receiving it. In case of delay, complaint must be made within 21 days from date the baggage was delivered.
9. This ticket is valid for carriage for one year from date of issue, except if otherwise stated on the ticket flight coupon or in the carrier’s tariffs, conditions of carriage, or related regulations. It is only valid for the specified routes and dates, and in the case of not being used is non-transferable, non-endorsable and non-refundable. Nor does thi ticket permit changes when it becomes an “OPEN TICKET” once issued. The fare for the carriage is subject to change prior to commencement of carriage. The carrier may refuse transportation if the applicable fare has not been paid.
10. The carrier employ its best efforts to transport the passenger and baggage with reasonable diligence. Times shown in timetables or elsewhere are not guaranteed and form no part of this contract. Without notice the carrier may substitute alternate carriers or aircraft, and if necessary may alter or omit stopovers shown on the ticket Schedules shown on the ticket or any other place are approximate, subject to modification and neither guarantee nor form part of this contract. The Carrier accepts no responsibility for making flight connections or connections with other types of transport.
11. The passenger shall comply with Government travel requirements. The passenger will present departure, entry and other necessary documents and arrive at airport by the time fixed by carrier or, if no stated time, early enough to complete departure procedures.
12. No agent, employee servant or representative of the carrier has authority to alter, modify or waive any provision of this contract.
INFORMATION NOTICE
New rules regarding the Carrier’s liability towards passengers and their luggage on domestic and international flights are applicable in compliance with the Montreal Convention (signed in Montreal on the 28th May 1999) and the new wording of the EC Regulation Nº 2027/97 (as amended by EC Regulation Nº889/2002).
The Conditions of Contract of Carriage (the ticket), the Baggage Check and conditions mentioned in any other document relating to the afore-mentioned Ticket and Baggage Check, or to the Carrier´s liability towards passengers, shall be applicable provided that these do not contradict the applicable conditions in the Montreal Convention and the EC Regulation Nº 2027/97.
This information notice summarises the liability rules applied by Community Air Carriers as required by Community legislation and the Montreal Convention.
Compensation in the case of death or injury: There are no financial limits to the liability for passenger injury or death. For damages up to 100000 SDRs (approximately EUR 107.000) the air carrier cannot contest claims for compensation. Above that amount, the air carrier can defend itself against a claim by proving that it was not negligent or otherwise at fault.
Advance payments: If a passenger is killed or injured, the air carrier must make an advance payment, to cover immediate economic needs, within 15 days from the identification of the person entitled to compensation. In the event of death, this advance payment shall not be less than 16000 SDRs (approximately EUR 17.000).
Passenger delays: In case of passenger delay, the air carrier is liable for damage unless it took all reasonable measures to avoid the damage or it was impossible to take such measures. The liability for passenger delay is limited to 4150 SDRs (approximately EUR 4.500).
Baggage delays: In case of baggage delay, the air carrier is liable for damage unless it took all reasonable measures to avoid the damage or it was impossible to take such measures. The liability for baggage delay is limited to 1000 SDRs (approximately EUR 1.100).
Destruction, loss or damage to baggage: The air carrier is liable for destruction, loss or damage to baggage up to 1000 SDRs (approximately EUR 1.100). In the case of checked-in baggage, it is liable even if not at fault, unless the baggage was defective. In the case of unchecked baggage, the carrier is liable only if at fault.
Higher limits for baggage: A passenger can benefit from a higher liability limit by making a special declaration at the latest at check-in and by paying a supplementary fee.
Complaints regarding baggage: If the baggage is damaged, delayed, lost or destroyed, the passenger must write and complain to the air carrier as soon as possible. In the case of damage to checked-in baggage, the passenger must write and complain within seven days, and in the case of delayed baggage within 21 days, in both cases from the date on which the baggage was placed at the passenger's disposal.
Liability of contracting and actual carriers: If the air carrier actually performing the flight is not the same as the contracting air carrier, the passenger has the right to address a complaint or to make a claim for damages against either. If the name or code of an air carrier is indicated on the ticket, that air carrier is the contracting air carrier.
Time limit for action: Any action in court to claim damages must be brought within two years from the date of arrival of the aircraft, or from the date on which the aircraft ought to have arrived.
Basis for the information: The basis for the rules described above is the Montreal Convention of 28th May 1999, included implemented in the Community through by Regulation (EC) No 2027/97 (as amended by Regulation (EC) No 889/2002) and national legislation of the Member States.

IMPORTANT NOTICES
1. This ticket is issued by AIR EUROPA LÍNEAS AÉREAS, S.A.U., trading as AIR EUROPA and accepted by the passenger subject to the Conditions of Contract, including all Notices and Advice herein.
2. If for any reason passengers are unable to travel as arranged, would they please inform the Carrier or its Agent as soon as possible.
3. AIR EUROPA LÍNEAS AÉREAS, S.A.U., trading as AIR EUROPA, is the Carrier only when “UX” of “AEA” is entered in the “Via Carrier” box of the Flight Coupon(s). Any other entry in that box denotes another Carrier, details available on request. Air Europa will inform to the passengers of the identity of the operating air carrier or carriers in the air carriage contracted.
4. The actual legislation in force, prohibits the onboard transportation of a series of articles which including, among others, inflammable materials, explosives, corrosive materials, oxidisers and organic peroxides, radioactive and magnetic materials, as well as pointed or bladed articles capable of causing injury. Nevertheless, a comprehensive list should be made available to the public, clearly distinguishing articles that are prohibited from being carried by passengers into restricted areas (the cabin of an aircraft) and rticles that are prohibited from being carried in baggage intended for stowage in the aircraft's hold, according to Regulation (EC) No 622/2003 modified by Regulation (EC) No 68/2004 of The Commission.The list of prohibited articles is available to passengers at check-in desks.
5. On all AIR EUROPA LÍNEAS AÉREAS, S.A.U. aircraft smoking is not permitted, except if stated to the contrary, especially during take off and landing and in the toilets.
6. CABIN BAGGAGE. For security and safety reasons only one piece of hand baggage per passenger can be carried in the cabin. This must not be larger than 55x35x25 cms. Or 20”x15”x10” and weight no more that 9 kilos or approximately 20 pounds. The dimensions shall include handles, straps, pockets, wheels and any other protruding items, including contents of the bag. The following additional items are also allowed in the passenger cabin free of charge:
- One small size handbag or purse.
- One coat or one cape o one blanket.
- One umbrella or a walking stick.
- One pair of crutches.
- One small camera, binoculars or a small laptop computer.
- One infant carrying basket or invalid’s fully collapsible wheelchair.
- A reasonable amount of reading material for the trip.
7. RESTRICTED HAND LUGGAGE: There are security measures adopted by the European Commision that restrict the amount of liquids or any other item of similar consistency that passengers can take through security checkpoints in a EU airport. For this purpose, liquids include: water and other drinks, soups, syrups, creams, lotions and oils, perfumes, sprays, gels, foams, deodorants, pastes, liquid-solid mixtures, mascara, and other items of similar consistency.
8. PORTABLE ELECTRONIC DEVISES (P.E.Ds): During the flight passengers may not use any portable electronic devises such as mobile telephones, laptops, tape-recorders, etc. as they may interfere with the electronic equipment of the aircraft. Some portable electronic devises may be used with the authorisation of the cabin crew.
9. NOTICE OF GOVERNMENT IMPOSED TAXES, FEES AND CHARGES. The price of this ticket may include taxes, fees and charges which are imposed on air transportation by government authorities. These taxes, fees and charges, which may represent a significant portion of the cost of air travel, are either included in the fare, or shown separately in the “TAX / FEE / CHARGES” box(es) of the ticket. The passenger may also be required to pay taxes, fees and charges not already collected.
10. SECURITY MEASURES. Passenger and hand baggage security checks are carried out at most airports prior to entering to the boarding area. Local authorities may remove those sharp items or any other articles considered to be of a dangerous nature.
To avoid possible inconveniences, we suggest that passengers pack such items in their checked-in baggage they wish to be checked-in.
Acceptance of pieces of luggage from other passengers or packages to be put into your own luggage with the intent of carrying them within your own maximum authorised weigh allowance is a breach of security measures and may give rise to passengers being prohibited from boarding the aircraft and being reported to the Airport Security Authorities.
11. Air Europa will provide carriage only to the passenger named in the ticket, and passengers may be requested to produce appropriate identification (ID card, passport or similar).
